General Terms and Conditions for Auckland Birthday Photography- www.aucklandbirthdayphotography.co.nz
1. Introduction
Welcome to www.aucklandbirthdayphotography.co.nz (“Auckland Birthday Photography”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) apply to your use of our website and the birthday photography services we provide. By booking with us or accessing our website, you confirm that you have read, understood, and agreed to these Terms in full.
2. Services
Auckland Birthday Photography specialises in capturing birthday celebrations of all ages — from children’s parties and milestone birthdays to family gatherings and private events. Our services include:
- Birthday and event photography
- Group and family portraits during celebrations
- The sale of digital images, physical prints, and gift vouchers
- Optional add-ons such as extended coverage, rush delivery, or premium photo albums
Travel fees may apply for bookings outside of Auckland. Please enquire for customised packages.
3. Booking and Payment
- Bookings can be made via our website or by contacting us directly.
- A 20% non-refundable deposit is required to secure your booking.
- The remaining balance is due on or before the day of the birthday/event.
- We accept payments via credit card, bank transfer, or cash.
- Bookings are confirmed only once the deposit has been received.
4. Cancellation and Refunds
- Cancellation of the Booking/Order by the Client must be in writing and must give reasonable notice to the Photographer. Subject to any specific terms in the Agreement, if the Client cancels the Booking/Order:
- a. Within 1 working day of the booked shoot day, the Client must pay a fee of 100% of the Photographer’s fees
- b. Giving notice of cancellation of greater than 1 working day and within 7 working days of the booked shoot day, the Client must pay a fee of 75% of the Photographer’s fees.
- c. Giving notice of cancellation of greater than 7 working days of the booked shoot day, the Client must pay a fee of 50% of the Photographer’s fees.
- d. The Client must pay the Photographer for all Job-Related Costs incurred.
5. Intellectual Property Rights
- All photographs taken by Auckland Birthday Photography remain the intellectual property of the photographer.
- Clients are granted a personal-use license only, allowing them to share and print images for private enjoyment.
- Commercial, advertising, or third-party use requires prior written agreement and may incur additional licensing fees.
6. Use of Photographs by Auckland Birthday Photography
Unless you choose to opt out in writing, you grant Auckland Birthday Photography permission to use selected images for portfolio, website galleries, social media, and promotional materials.
We respect your privacy. If you prefer that no photos of your birthday celebration are shared, simply notify us in writing before or immediately after the session.
7. Delivery of Photos & Products
- Digital Images: Delivered via secure online gallery within 10 working days after the event.
- The gallery link will remain active for 2 weeks.
- We will store your images for 1 month after delivery; beyond this period, we are not responsible for archiving.
- Prints & Products: Physical prints, albums, or wall art are usually ready within 21 working days, depending on supplier and courier schedules.
8. Liability
- We will take every care to capture your birthday celebration to a high professional standard. However, Auckland Birthday Photography cannot be held responsible for unforeseen issues such as venue restrictions, poor lighting conditions, or guest interference that may affect photo quality.
- Our liability, whether in contract or tort, will not exceed the total amount paid for the booked service.
- Clients are responsible for ensuring guest cooperation during the session.
9. Sessions Involving Children
As many of our sessions involve children:
- A parent or legal guardian must provide consent for photography involving anyone under 18 years of age.
- The supervising adult(s) are responsible for ensuring children’s safety and behaviour during the session.
10. Force Majeure
We are not liable for delays, cancellations, or non-performance caused by events beyond our control, including illness, extreme weather, equipment failure, pandemics, or government restrictions.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
12. Changes to Terms
We reserve the right to update or amend these Terms at any time. Updated terms will be posted on this page, and continued use of our services indicates your acceptance.
